Introduction

The following terms and conditions will apply to the use of the kizoo.gr e-shop located at www.kizoo.gr. Any user who enters and transacts or makes use of the services of the e-shop (hereinafter referred to as “visitor” and/or “user” or “customer” depending on whether it is limited to a shop visit only or if an order is placed as well, and products and services are sold) is deemed to consent and unconditionally accept the following terms set forth herein, without any exception. If some user does not agree with these terms, then it is his/her responsibility to refrain from visiting, using the site, and transacting or enjoying the e-shop services.

General Terms & Conditions

The COMPANY reserves the right to freely modify or revise the terms & conditions pertaining to the use and transactions of the e-shop, at any time the COMPANY deems necessary, and undertakes to inform consumers of any modification through the pages of our e-shop. Contracts through the e-shop are established in Greek.

Information and Products

The COMPANY is committed to the accuracy, truth and completeness of the information supplied in our e-shop, regarding the identity of the COMPANY and the transactions that may take place through the e-shop. The COMPANY, in good faith, is not responsible nor bound by entries of electronic data made by mistake or inadvertently according to common sense, and reserves the right to correct such mistakes at any time the COMPANY becomes aware of them.

Limitation of Liability

The COMPANY, based on the transactions conducted through the e-shop, shall not be responsible nor shall it be required to provide compensation for any damage or defect arising due to an order cancellation, its non-implementation or the delayed implementation thereof, or due to any other reason whatsoever. The COMPANY does not guarantee the availability of the products exhibited in the e-shop, but informs the customer on the basis of the data held about the availability or not, and undertakes, in the event such data change, to inform the customers in a timely manner about their unavailability, in which case the COMPANY shall not bear any further responsibility. The e-shop provides the content (eg information, names, photos, illustrations), the products and services available through the website “as is”. In no case shall the COMPANY be liable in the civil or criminal context for any damage (incidental, special or consequential, which indicatively and not restrictively, severally and/or jointly, consists of economic damages, loss of data, lost profits, financial remedies, etc.) that a visitor of the e-shop or a third party may sustain due to any issue related to the operation or not and/or use of the website and/or failure to provide services and/or products and/or information available from it and/or from any unauthorized third party interventions in products and/or services and/or information available through it.

User Responsibility

The user/customer agrees and undertakes to use the services, information and data of the e-shop  as provided by law and based on the rules of good faith and business ethics. The user/customer is obliged not to use the e-shop under the trademark kizoo.gr for: 1. sending, publishing, e-mailing or otherwise transmitting any content that is illegal for any reason whatsoever, that causes unlawful infringement and damage to the company or to any third party or that violates the confidentiality or classification of information of any person 2. sending, publishing, e-mailing or otherwise transmitting any content that causes violation of morals, of social values, or that is offensive to minors, etc. 3. sending, publishing, e-mailing or otherwise transmitting any content for which users have no right to broadcast in accordance with the law or the contracts in force (such as inside information, proprietary and confidential information acquired or disclosed as part of employment relationships or covered by confidentiality agreements), 4. sending, publishing, e-mailing or otherwise transmitting any content which infringes any patent, trademark, trade secret, copyrights or other proprietary rights of any third party of any kind, 5. sending, publishing, e-mailing or otherwise transmitting any material containing software viruses or any other codes, files or programs designed to interrupt, cause harm, destroy or equip it operation of any computer software or hardware, 6. intentional or unintentional violation of applicable law or provisions, 7. harassment of third parties in any way, 8. collection or storage of personal data about other users.

Restricted license

Kizoo.gr, under the terms and conditions set out herein and all applicable laws and regulations, grants you a non-exclusive, non-transferable, personal, limited right of access, use and presentation of this website and its contents. This license does not constitute a title transfer to the website and its components and is subject to the following restrictions: (1) you must retain all copies of the website and its components, all notices relating to copyright and other proprietary rights and (2) you may not modify the website and its details in any way or reproduce or publicly present, or distribute or otherwise use the website and its details for any public or commercial purpose, unless otherwise permitted herein.

The links included in the e-shop, lead to pages of the shop or in some cases lead the user to leave (the e-shop) and be liked to websites of third party providers, businesses, etc. These related websites are not under the control of the COMPANY and the COMPANY is not responsible for the contents of any such website or any link included in an associated website, or any changes or updates to such websites. The COMPANY is not responsible for online broadcasts or any form of broadcast received from any linked website. The COMPANY provides these links to its e-shop, only to facilitate the use of the e-shop; their use is not mandatory for the visitor/customer and the fact that they are included in the e-shop does not indicate that the company approves or accepts their content.

The COMPANY  created this website with the sole purpose of serving its customers. The website kizoo.gr is simple and user-friendly and is designed to meet the specific needs of each user. In order to achieve best customer service, it is important that you, our customer, understand that you must provide us with specific information regarding the processing of your order, which we safely keep.
 The processing of personal data is carried out in accordance with the provisions of the General Data Protection Regulation (GDPR 2016/679), and with any more specific national and European legislation for certain sectors, with the applicable Greek legislation for the protection of personal data, as well as for the protection of personal data and privacy in the electronic communications sector (Law 3471/2006, as in force) and the decisions of the Personal Data Protection Authority (GDPR Authority). The company has adapted to the GDPR framework.

The present Personal Data Protection Statement and the attached Terms and Conditions of use of the present website describe how the data are collected from kizoo.gr, how they are used by us, as well as the terms and conditions of use of kizoo.gr website. The present Personal Data Protection Statement refers exclusively to your personal data, that you provide to the Company when placing your orders on this site.

What is personal data?

Personal data is information that identifies you directly or indirectly. Indirectly means in conjunction with other information, such as your name, mailing address, email address and telephone number, or a unique device identification number.

The information provided voluntarily by the users of the website, is used by the Company, in order for its users to have direct and substantial communication with the shop, to be provided with answers to specific questions they ask and finally to serve and execute their orders. The information collected by kizoo.gr is intended to measure its number of visitors, to determine the customer requirements for more products and to facilitate transactions with the company. kizoo.gr does not distribute to any other organization or partner that is not affiliated with kizoo.gr the email addresses, or any other information concerning its users and customers, except to direct partners in the order service process.

kizoo.gr designed its website so that its users can visit it without having to reveal their identity unless they wish to do so. It is requested from our website visitors to provide their personal data only if they wish to place an order, to register on our website and/or send an email to kizoo.gr.

Use of information. Kizoo.gr collects four types of information about users: (1) information that the user gives us when registering as a customer, (2) information that the user gives us in order to have kizoo.gr execute the order placed, (3) information that the user gives us when participating in competitions that take place from time to time, (4) information that the user gives us for activations of telephony and internet services, (5) information that the user gives us when connecting through another platform ( applications for ios, android, Facebook, Google). When filling out any order form on our website, you will be asked for the name, address, postal code of your area, your email address, your phone number, the method of payment of the order. You may be additionally asked for more specific information, such as shipping – delivery of an order, invoicing information or details related to the offer you requested. Kizoo.gr makes use of the information you give us during the electronic sending of the form, in order to contact you regarding (i) the delivery of the order, (ii) for confirmation and identification of the customer whenever deemed necessary.

Access to Information  Each processing of orders requires the collection of personal data for the delivery or the placing/reserving of an order. Furthermore, when using a credit card for the first time, in order to debit any amount, identification documents of the legal holder are required and the use of the card is guaranteed at all times. Any document certifying and disclosing the identity of the customer remains strictly confidential and is controlled only by the competent department of kizoo.gr. When submitting your personal data it means that you consent to this data being used by the Company for the reasons mentioned above. kizoo.gr requires its employees and website operators to provide users-customers the safety level referred to at the Personal Data Protection Statement.  In no other case can kizoo.gr share your personal information with others without your prior consent, unless this is required through legal channels. We will use your personal data for the purposes described above. We do not collect nor process more or other types of personal data than those necessary to fulfill the respective purpose. The text messages that are sent to the mobile phone number you have provided when placing your order, serve the purpose of keeping you updated regarding your order. Refund policy

In supporting e-Commerce, the COMPANY gives you the opportunity, through the completeness of the descriptions it posts on its pages, to enjoy the privilege of direct contact with the products it offers from your computer screen quickly and easily.
 We want to highlight the benefits of using the Internet in our daily purchases below the terms and conditions for returning defective or non-defective products.

Products returns due to delivery errors

In all cases where products other than those sold are delivered, by type or quantity or missing a property which has been previously agreed in writing with the company, the customer returns the products for verification and detection of the error. In this case the cost of returning the products to the company as well as the cost of forwarding them to the customer shall be borne by the company as long as the method of return proposed by the company is respected.

Return of defective products

In case it is found that the item has a manufacturing defect, if this is certified by the authorized repairer who provides the guarantee of good operation or in case the company itself provides directly the guarantee of good operation, the following shall apply:

  • The warranty is provided for a limited period of time indicated in the detailed product characteristics. After the end of this period or repair the replacement of the products is possible at an additional charge upon new agreement with the customer.
  • The return of the product to be replaced should be made along with all the documents that accompanied the product (e.g. Shipping document, Retail receipt etc.) and its full packaging. If the defect was found after the delivery and the packaging does not exist or, if the packaging of the product was received by the distributors at the time of delivery, the packaging of the product is not required.
  • The return of the products will take place either by personal and means of transport of the COMPANY or by courier, or in any of the stores maintained by the company under the trademark “kizoo.gr” on the Greek Territory. In cases of return by courier, the customer shall bear the cost of the shipment to the COMPANY and the COMPANY shall bear the cost of the shipment of the replaced or repaired product.
  • After the return of the products, the defect mentioned by the customer is checked and then contacted for information on the results of the check.
  • If the defect is found, repair, or replacement of the product is carried out, otherwise cancellation of the transaction in the event that it is not possible to repair the product within a reasonable time and no other product of corresponding or better characteristics or of equivalent value for the replacement can be found by the COMPANY. In case of cancellation of the transaction, the refund of the original purchase is made in the same way as the original payment of the customer to the COMPANY.
  • In particular, in case of debit by credit card, the company will be obliged to inform the issuing Bank about the cancellation of the transaction and the bank will then proceed to any action provided under the contract it has drawn up with the customer without the COMPANY’S responsibility anymore. Upon receipt of this information, the COMPANY bears no responsibility for the timing and manner of execution of the reversal, which is governed by the aforementioned contract. In the case of cash payment, if the customer had opted for the option of “picking up from the store”, his money will be returned to him from any branch of the COMPANY’S network. In case of payment by bank transfer, a reverse bank transfer will be made from the COMPANY’S accounts to the customer.
  • In the event that the products are returned damaged or incomplete, the Online Store has the right to request compensation from the customer, the amount of which will be determined by the condition of the products and to proceed unilaterally and without others to a total or partial offset of his claim against the customer.

Returns of products considered to be defective upon delivery (DOA)

The return of the products, which are considered defective upon delivery (DOA) will be accepted within seven (7) calendar days of their delivery to the customer. At the same time, the product should not be damaged and should have all the original documents that accompanied the product (e.g. Shipping document, retail receipt, etc.) and its complete packaging. In such cases the following shall apply:

  • The product is received and checked for the defect mentioned by the customer.
  • Provided that these have been received and checked beforehand by the company, the item will be replaced with a similar new one, or in case of unavailability with another new product of corresponding quality and price, otherwise in case the customer does not want a replacement, the money of the initial purchase will be refunded to the customer. The refund is made in the same way as the customer had made the initial payment to the company.
  • In particular, in case of debit by credit card, the company will be obliged to inform the issuing Bank about the cancellation of the transaction and the bank will then proceed to any action provided under the contract it has drawn up with the customer without the COMPANY’S responsibility anymore. Upon receipt of this information, the COMPANY bears no responsibility for the timing and manner of execution of the reversal, which is governed by the aforementioned contract. In the case of cash payment, if the customer had opted for the option of “picking up from the store”, his money will be returned to him from any branch of the COMPANY’S network. In case of payment by bank transfer, a reverse bank transfer will be made from the COMPANY’S accounts to the customer.
  • The shipping costs for the return of the products to the company and for the return of the replaced product to the customer are borne by the company.
  • In the event that the products are returned damaged or incomplete, the Online Store has the right to request compensation from the customer, the amount of which will be determined by the condition of the products and to proceed unilaterally and without others to a total or partial offset of his claim against the customer.
  • In the case of air conditioners, a visit by the technician of the authorized workshop of the supplier company and a written certificate regarding the diagnosis of the device failure is required in order for the product to be considered as defective at the time of delivery (DOA).

Return of non-defective products – Right of unjustified withdrawal by the customer

The customer has the right to withdraw from the purchase contract within a period of 14 calendar days from the date of conclusion of the service contract (in the case of such a contract), or from the delivery (in the case of products) and especially when there are many products in the same order from the delivery of the latter, while there is an obligation to deliver products at regular intervals from the delivery of the first. The withdrawal is subject to the following conditions:

  • This withdrawal is unjustified and free of charge and if the item has already been delivered, the customer must return the product exactly in the condition in which it was received, with all its parts, the accompanying forms and its packaging in excellent condition. The return of the item shall be accepted only after the buyer has paid any amount charged by the company for the shipment of the item to him and the shipping costs for the return of the item.
  • The declaration of withdrawal  shall be in writing or electronically and the COMPANY is obliged to send confirmation of receipt of the withdrawal statement as soon as it has been received.
  • The consumer shall, within 14 days of notification to the company of his request for withdrawal, return the product (s) in accordance with the terms of this paragraph.
  • Following the declaration of withdrawal, the COMPANY is obliged to pay the price it received much within 14 days from the receipt of the products.
  • Shipping costs are not refundable if the customer had chosen a delivery method other than the cheapest standard delivery method offered by the COMPANY
  • The refund will be refunded to the customer using the same means as the original payment. Specifically, in the case of debiting by credit card as follows: in the event that until the withdrawal and return of the item, the price has been paid to the company by the Bank, the company will be obliged to inform the Bank of the cancellation of the transaction and the bank will proceed to any action provided under the contract it has drawn up with the customer. Upon receipt of this information, the COMPANY bears no responsibility for the timing and manner of execution of the reversal, which is governed by the aforementioned contract. In the case of cash payment, if the customer had opted for the option “pick up at the shop”, his money will be returned to him from the store where he received the product. In the case of a bank transfer payment, the refund will also be made by bank transfer to the client’s bank account.
